Supreme Court Declines Relief in Jana Nayagan Case, Sends Matter Back to Madras High Court

Observing that the issue is already listed before the High Court, the bench said the matter should be decided there instead of seeking extraordinary relief from the Supreme Court.

KVN Productions, the banner backing the film, urged the Supreme Court to expedite the case related to the Central Board of Film Certification (CBFC) clearance. The producers argued that nearly 5,000 theatres had already been booked and the proposed release date of January 9, 2026, had passed, leading to substantial financial losses due to the delay.
Court’s Observation and Stand
Senior advocate Mukul Rohatgi appeared on behalf of the filmmakers during the hearing. Responding to the plea for urgent relief, Justice Dipankar Datta questioned why a “super-fast” judicial process should be applied to a single film. The court further clarified that it could not override the order passed by the Madras High Court’s division bench. On these grounds, the Supreme Court dismissed the petition and asked the producers to approach the High Court.
Censor Certificate at the Centre of the Dispute
The core issue delaying Jana Nayagan is the CBFC certification. Earlier, a single bench of the Madras High Court had directed the censor board to issue a UA certificate to the film. However, the CBFC raised objections, stating that certain visuals and references related to the Indian armed forces required examination by military experts before certification could be granted.

Following the CBFC’s appeal, a division bench of the Madras High Court stayed the single bench’s order. The division bench observed that granting certification without a thorough review of the objections would amount to undue haste.
